Personal Training Services Agreement

1. Parties to This Agreement

This Personal Training Services Agreement ("Agreement") is entered into as of the date signed below between KP Total Estate ("Trainer") and the Client identified below. All services are delivered virtually unless otherwise agreed in writing.

2. Services & Package Selection

Trainer agrees to provide virtual personal training, nutrition coaching, and wellness support under the package selected below.

3. Session Expiration & Non-Rollover Policy

IMPORTANT: Unused sessions do NOT roll over. All sessions expire 30 days from the billing date.

All sessions included in a monthly package must be scheduled and completed within 30 days of the package billing date (the "Expiration Date"). Sessions not used by the Expiration Date are permanently forfeited with no refund, credit, or carryover.

3.2 No Rollover. No Exceptions.

Unused sessions cannot be:

  • Carried over to the following billing month
  • Transferred to another person
  • Credited toward future packages or promotions
  • Redeemed for a partial or full refund

3.3 Medical or Emergency Extension (Trainer Discretion Only)

In the event of a documented medical emergency preventing attendance, Trainer may, at their sole discretion, grant a one-time extension of up to 14 days. Client must notify Trainer in writing within 48 hours of the first missed session and provide supporting documentation within 5 business days.

3.4 Trainer-Cancelled Sessions

If Trainer cancels a scheduled session, Client receives a make-up session at no charge, to be completed before the Expiration Date.

4. Cancellation & No-Show Policy

4.1 Required Notice

Client must provide a minimum of 24 hours' advance notice to cancel or reschedule any session.

4.2 Late Cancellations

Cancellations with less than 24 hours' notice will be counted as a used session and deducted from Client's package without refund or reschedule.

4.3 No-Shows

Failure to attend without notice is a no-show. No-show sessions are forfeited in full and deducted from the package.

4.4 Late Arrivals

Sessions begin and end at scheduled times regardless of late arrival. The full session is counted as used.

5. Payment Terms

Monthly package fees are due in full on or before the billing date each month. Accepted payment methods: credit card, debit card, or ACH bank transfer.

Packages are non-refundable once the billing period has commenced. Outstanding balances do not pause or extend the 30-day session expiration window. A late fee of $50.00 will be assessed for payments received more than 3 days past the due date.

6. Health Disclosure, Liability Waiver & Unforeseen Circumstances

6.1 Health Disclosure

Client represents that they are in adequate physical condition to participate in a personal training and wellness program. Prior to beginning any sessions, Client has fully and accurately disclosed to Trainer all known health conditions, prior injuries, surgeries, physical limitations, chronic illnesses, and any physician-imposed restrictions. Client agrees to promptly notify Trainer in writing of any changes in their health status, including new injuries, diagnoses, or medical advice received during the term of this Agreement.

6.2 Assumption of Risk

Client acknowledges that physical exercise, strength training, and nutritional changes involve inherent risks of injury, illness, and adverse physical effects, including but not limited to:

  • Muscle strains, sprains, tears, or ligament damage
  • Joint injuries, including to the knees, shoulders, hips, and spine
  • Cardiovascular responses including elevated heart rate or blood pressure
  • Dizziness, nausea, or fatigue during or after exercise
  • Bone stress injuries or fractures, particularly relevant to post-menopausal clients
  • Adverse reactions to nutritional or dietary changes
  • Aggravation of pre-existing conditions

Client voluntarily and knowingly assumes all such risks, whether known or unknown, arising from participation in the Services.

6.3 Release of Liability

To the fullest extent permitted by applicable law, Client hereby releases, waives, and holds harmless KP Total Estate, its owner Kristie Perry, employees, contractors, and agents from any and all claims, liabilities, losses, or damages (including reasonable legal fees) arising from:

  • Any injury or physical harm sustained during or as a result of training sessions or following program guidance
  • Any injury sustained in Client's home or chosen exercise environment during virtual sessions
  • Any adverse reaction to nutritional coaching or meal recommendations
  • Any aggravation of a pre-existing condition not disclosed to or not known by Trainer
  • Any unforeseen medical event during or after a session, including cardiac events, fainting, or allergic reactions

6.4 Unforeseen Circumstances

Client acknowledges that unforeseen circumstances (including sudden injury, acute illness, family emergency, bereavement, natural disaster, or other events beyond either party's control) may disrupt the training schedule. In such events:

  • Client must notify Trainer as soon as reasonably practicable
  • Trainer will make reasonable accommodations at their sole discretion
  • Unforeseen circumstances do not automatically entitle Client to a refund, session rollover, or billing suspension
  • If Trainer experiences an unforeseen circumstance preventing delivery of a session, Client will receive a make-up session at no charge

6.5 Emergency Protocol

In the event of a medical emergency during a virtual session, Client agrees to immediately stop activity, call emergency services (911 or local equivalent), and notify Trainer as soon as safely possible. Trainer is not a licensed medical professional and is not responsible for providing emergency medical care.

7. Termination

Either party may terminate this Agreement with 7 days' written notice. Upon termination, sessions remaining within the current 30-day window will be honored during the notice period only. No refunds will be issued for unused sessions after the termination date.

8. Governing Law

This Agreement shall be governed by the laws of the State of Texas. Any disputes shall be resolved through good-faith negotiation and, if unresolved, through binding arbitration.

What's included in each fitness plan?

All three tiers (Foundation, Transition, and The Freedom Phase) include a custom periodized training program, access to the Client Portal, weekly check-ins, progress tracking, and direct messaging with Kristie. Higher tiers include more frequent programming updates, deeper customization, and priority response times. Review the plan cards above for a full tier-by-tier breakdown.

Can I add a meal plan to any fitness tier?

Yes. A custom nutrition meal plan can be added on top of any fitness subscription, either as a Monthly Meal Plan (+$197/mo) or a Weekly Meal Plan (+$397/mo). The add-on is selected during checkout before you proceed to payment. Nutrition is not available as a standalone service without an active fitness plan.

Do I need to be in perimenopause or menopause to work with Kristie?

No. Perimenopause and menopause are Kristie's specialty, not a requirement. As a NASM-certified personal trainer and nutrition coach, Kristie works with women at any stage of life: complete beginners in their 30s, women returning after a long break, clients focused on strength and longevity in their 60s and 70s, and everyone in between. Her approach adapts to your biology and your goals. If hormonal shifts are part of your picture she accounts for them, but you don't need to be navigating menopause to benefit from working with her. What matters is that you're ready to show up and do the work.

What happens immediately after I pay?

Right after payment is confirmed you'll see a success screen with two next steps: first, book your Introductory Fitness Assessment using the Cal.com calendar that appears on screen. This is your free one-on-one session with Kristie to kick everything off. Second, complete your PAR-Q health intake form so Kristie has everything she needs to build your program safely and effectively.

What is the Introductory Fitness Assessment?

It's a free 45-minute one-on-one session with Kristie, held before your program officially begins. Kristie uses this time to evaluate your current movement patterns, understand your goals, discuss any injuries or limitations, and align on what your first training block will look like. If you added a nutrition plan, she'll also cover your dietary preferences and goals during this session.

What is the PAR-Q form and why do I need to fill it out?

PAR-Q stands for Physical Activity Readiness Questionnaire. It's a standard health screening form that helps Kristie understand your medical history, any conditions that may affect training, and whether medical clearance is needed before you start. It takes about 5 minutes to complete and is required before your program launches.

How does billing work? Is it month-to-month?

Yes. All plans are billed monthly through PayPal subscriptions. There are no contracts or long-term commitments. Your first charge processes at the time of enrollment, and subsequent charges recur on the same date each month. You can manage or cancel your subscription directly through your PayPal account at any time.

Do you offer refunds?

Programs are custom-built from the moment you enroll, so payments are non-refundable once a billing cycle has started. You can cancel at any time through your PayPal account and your access continues through the end of the period you paid for. You won't be charged again after canceling. If something unexpected comes up, reach out to Kristie directly through the Client Portal to discuss your options.

Can I cancel or pause my subscription?

You can cancel your PayPal subscription at any time through your PayPal account settings. Per the cancellation policy in your signed waiver, cancellations take effect at the end of the current billing cycle. There are no partial refunds for mid-month cancellations. If you need to pause due to travel, injury, or life circumstances, reach out to Kristie directly through the Client Portal to discuss options.

Can I upgrade my plan after I've already enrolled?

Yes. If you start on Foundation and want to move up to Transition or The Freedom Phase, simply message Kristie through the Client Portal. She'll walk you through the upgrade process, cancel your current subscription, and set up the new tier with no gap in your program.

Do I need a gym membership or special equipment?

Not necessarily. During your introductory assessment, Kristie will ask about your access to equipment and design your program accordingly, whether that's a full commercial gym, a home setup, or minimal equipment. Programs can be adapted to virtually any environment.

How soon can I start training after signing up?

Your program begins after your Introductory Fitness Assessment and PAR-Q form are both completed. Most clients have their assessment booked within the first 48 hours of enrolling and receive their first training block shortly after. The sooner you book and complete those two steps, the sooner you start.
